Law in Action: KRAIL Calls Attention to Gambling Advertising Rules

The state regulatory body, Commission for the Regulation of Gambling and Lotteries (KRAIL) was created to monitor the work of operators organizing and conducting gambling in Ukraine. However, the scope of the Commission’s activities gradually expanded. Therefore, the first amendments were made to the Law of Ukraine “On Advertising”, according to which control over the publication of gambling advertisements was transferred to the KRAIL.

The state regulator noted that popular casinos, as well as companies involved in placing and creating advertising products, must be familiar with the new conditions. The main condition is that advertising must be placed only with authorized gambling operators.

To conduct gambling legally, the following legal requirements must be taken into account:

  • It is prohibited to place logos and names of companies operating in the field of gambling on products that can be used by citizens who have not yet turned 21 years of age;
  • It is also prohibited to involve such people in creating advertising in the gambling industry, including as models;
  • placement of advertising in public places (city transport, sports grounds, theaters, concerts) is limited;
  • advertising material should not create narratives that by gambling you can get rich quickly and solve your financial problems.

Currently, CRAIL undertakes to check all reports received to it about violations related to gambling advertising. To stop their spread, government regulators issue orders requiring violators to remove such advertising materials.

CRAIL may, through its authority, impose fines on entities that do not comply with the requirements for the creation and placement of advertising materials related to the gambling domain. The fine is 2.13 million hryvnia ($76,680).
