As of September 9, 2024, Kazakhstan has implemented stringent regulations on the advertising of bookmakers and sweepstakes. The Ministry of Tourism and Sports, along with the Committee for the Regulation of Gambling and Lottery, have issued clarifications on these restrictions.
Prohibited Advertising Locations for Bookmakers
- Outdoor Advertising: Ads cannot be displayed on streets, building facades, transport, or external structures. The only exceptions are for bookmakers’ premises, sports venues, and athletes’ equipment; however, bookmaker logos cannot be used to advertise unrelated products or services.
- Mass Media: Bookmaker ads are generally banned in mainstream media, directories, and cinemas. Advertising is allowed on specialized sports channels, while general TV channels (like Khabar and Qazaqstan) may only show bookmaker ads during live broadcasts of international sporting events.
- Transport: Advertising for bookmakers is strictly prohibited on all forms of public and private transport.
Permitted Advertising Opportunities
- Sports Media: Bookmakers can advertise exclusively on dedicated sports TV channels and in sports publications registered to cover sports content exclusively.
- Sports Equipment and Events: Logos and trademarks of bookmakers are permitted on athletes’ equipment and sporting goods.
- Live Broadcasts: Advertising during live international sports broadcasts is allowed, but ads before and after the broadcast are prohibited.
- Event and Venue Names: Bookmaker names may be included in the official titles of sports events and venues, provided this complies with legal requirements.
Non-compliance with these regulations on bookmaker advertising can result in administrative fines.
- First violation: individuals – 60 MCI (Monthly calculated indicator), officials – 80 MCI, small businesses – 120 MCI, medium – 170 MCI, large businesses – 400 MCI.
- Repeated violation within a year: individuals – 170 MCI, officials – 200 MCI, small business – 250 MCI, medium – 350 MCI, large – 650 MCI.
The advertiser, advertising producer and distributor are responsible for violating the law.
