Kazakhstan Launches the Unified Accounting System Operator for the Gambling Industry

The Government of the Republic of Kazakhstan approved a resolution to establish the Limited Liability Partnership “Unified Accounting System Operator” (hereinafter referred to as the Partnership). According to the resolution, the Partnership will be created with full state participation in its authorized capital.

The primary activity of the operator will be to ensure the functioning of the Unified Accounting System in accordance with the Law “On Gambling Business.”

The authorized capital of the Partnership will be formed using state property managed by the Ministry of Tourism and Sports.

It is worth noting that Article 12-2 of the law specifies that the operation of the Unified Accounting System is provided by a legal entity designated by the authorized body based on approved rules and qualification requirements.

The following requirements apply to the legal entity responsible for ensuring the operation of the Unified Accounting System:

  • Availability of software and technical resources enabling the operation of the Unified Accounting System, with servers located in Kazakhstan.
  • Registration with the National Bank of the Republic of Kazakhstan for the provision of payment services or possession of a license for conducting banking operations.

Entities that cannot serve as the operator of the Unified Accounting System:

  • Legal entities not registered within the territory of Kazakhstan.
  • Organizations included in the list of entities associated with financing terrorism and extremism.
  • Entities with outstanding obligations under enforcement documents and listed in the Unified Registry of Debtors by the authorized body.
  • Legal entities whose founders, participants, executive bodies, or affiliated persons are individuals:
  • With unexpunged or uncleared criminal records for economic crimes, intentional medium-gravity crimes, serious crimes, or especially serious crimes.
  • Listed as persons associated with financing terrorism and extremism.

Why the Unified Accounting System is Needed

According to Kazakhstan’s legislation, any cash or cashless payments, including the use of electronic money, between betting participants and operators or totalizators, as well as payout of winnings, are allowed only with the involvement of the Unified Accounting System.

Additionally, the Unified Accounting System must prevent the acceptance and processing of payments, including electronic money, from or to individuals listed in the registry of those restricted from participating in gambling or betting.
