If the initiative gains momentum, its impact could extend beyond Poland\u2019s borders. Industry stakeholders are likely to call on the EU to intervene in curbing illicit payment facilitation.<\/p>\n\n\n\n<p><strong>Since 2017<\/strong>, Poland has had a law in place prohibiting<strong> payment service providers (PSPs)<\/strong> from processing transactions for websites listed in the <strong>Register of Domains Used for Offering Gambling in Violation of the Law<\/strong>. PSPs are required to block such payments within 30 days of a site being added to the list. However, in practice, enforcement has often been inconsistent, allowing the grey market for online gambling to thrive.<\/p>\n\n\n\n<p>Now, Polish regulators are renewing their focus. Authorities are targeting financial intermediaries that continue to process transactions for offshore gambling operators, despite legal bans. Their main objective is to eliminate <strong>around 41% of the market<\/strong> that currently falls outside of national regulatory oversight.<\/p>\n\n\n\n<p>Poland maintains a state monopoly on online casinos, held exclusively by <strong>Totalizator Sportowy<\/strong>. However, this monopoly is constantly undermined by unauthorized operators &#8211; many of whom find partners among payment institutions that knowingly or carelessly facilitate transactions that bypass domestic regulators.<\/p>\n\n\n\n<p>The issue took center stage at the <strong>European Financial Congress<\/strong>, held in Sopot in June, which focused on the financial sector\u2019s role in supporting the grey gambling market. Attendees included:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Beata Stelmach (CEO of Totalizator Sportowy),<\/li>\n\n\n\n<li>Maciej Akimow (CEO of iGaming Dragon),<\/li>\n\n\n\n<li>Tadeusz Bia\u0142ek (representative of the Polish Bank Association),<\/li>\n\n\n\n<li>Adam Lamentowicz (executive at Superbet Group and President of the Polish Chamber of Entertainment and Betting Industry),<\/li>\n\n\n\n<li>Marcin Miko\u0142ajczyk (representative of the Polish Financial Supervision Authority \u2013 KNF), and<\/li>\n\n\n\n<li>Jerzy Mroczek (representative of the BLIK payment system).<\/li>\n<\/ul>\n\n\n\n<p>At the congress, a proposal was made to create a dedicated task force focused on fighting the flow of funds to illegal operators.<\/p>\n\n\n\n<p>The declarations from the congress quickly materialized into real-world action. A discussion emerged on LinkedIn noting that the <strong>Polish Financial Supervision Authority (KNF)<\/strong> had sent letters to several payment companies. The regulator stated that it had identified some PSPs providing payment services for online gambling in Poland without the necessary licenses, and even cooperating among themselves in doing so.<\/p>\n\n\n\n<p>KNF has demanded that payment providers immediately audit their operations in this context and cease offering such services in accordance with Poland\u2019s Gambling Act.<\/p>\n\n\n\n<p>This sends a strong signal to all participants in the payments market. It\u2019s important to note that not every entity facilitating payments is officially registered as a payment institution, yet such entities may still face liability &#8211; administrative, criminal, or fiscal-criminal.<\/p>\n\n\n\n<p>Simply put, payment providers &#8211; whether deliberate collaborators or negligent intermediaries &#8211; may be viewed as enablers of the shadow economy. While Poland is taking firm action, the situation reflects broader challenges across the EU, where countries struggle to combat grey-market gambling in the absence of a unified legal framework.<\/p>\n\n\n\n<p>Currently, there are <strong>n<\/strong>o EU-wide regulations specifically governing gambling, aside from a few general provisions that apply across all member states. However, there is a clear trend toward financial regulatory harmonization. The gambling sector has already adapted to operating underground and is actively embracing cryptocurrencies.<\/p>\n\n\n\n<p>Still, the <strong>MiCA Regulation (Markets in Crypto-Assets Regulation)<\/strong> is set to come into force soon, introducing EU-wide rules for crypto-assets, including requirements for market participants and anti-money laundering procedures.<\/p>\n\n\n\n<p>Whether this paves the way for a more coordinated EU approach to gambling oversight remains to be seen.
