{"id":10728,"date":"2025-09-10T09:03:33","date_gmt":"2025-09-10T08:03:33","guid":{"rendered":"https:\/\/sbceurasia.com\/en\/?p=10728"},"modified":"2025-09-10T09:03:37","modified_gmt":"2025-09-10T08:03:37","slug":"german-regulators-warn-about-the-risks-of-polymarket-event-contracts","status":"publish","type":"post","link":"https:\/\/sbceurasia.com\/en\/2025\/09\/10\/german-regulators-warn-about-the-risks-of-polymarket-event-contracts\/","title":{"rendered":"German Regulators Warn About the Risks of Polymarket \u201cEvent Contracts\u201d"},"content":{"rendered":"\n<p>In Germany, a warning has been issued to gambling consumers that \u2018social betting platforms\u2019 are not permitted under the laws of the <strong>Fourth Interstate Gambling Market (Gl\u00fcNeuRStv).&nbsp;<\/strong><\/p>\n\n\n\n<p>A stern warning was issued by <strong>Gl\u00fccksspielbeh\u00f6rde (GGL), the Federal Authority of German Gambling, <\/strong>in response to what it described as an influx of national media reports about an increasing number of \u201centertainment-type bets\u201d placed on the outcome of the Ukraine war.<\/p>\n\n\n\n<p>The disputed wagers reflect \u201cevent contracts\u201d offered by prediction-based trading platforms, such as Polymarket, that are not licensed under the GGL\u2019s regime.<\/p>\n\n\n\n<p><strong>What are event contracts?<\/strong><\/p>\n\n\n\n<p>Wagers on news and entertainment markets can be placed as \u2018event contracts\u2019, and the GGL has been forced to remind consumers that such offers are not applicable with Gl\u00fcNeuRStv laws. Bans and restrictions are further applied to social betting platforms, which use tokens to wager on outcomes.&nbsp;<\/p>\n\n\n\n<p>In the US, contracts are offered by companies like Polymarket and Kalshi. Players can trade them as shares that represent the likelihood of real-world event outcomes.&nbsp;<\/p>\n\n\n\n<p>Such events can range from anything like political elections, economic fluctuations, sport results, and geopolitics.<\/p>\n\n\n\n<p>Treated as a completely separate concept from betting, event contracts are overseen by the US <strong>Commodity Futures Trading Commission (CFTC) <\/strong>\u2013<strong> <\/strong>the regulator of derivatives markets.&nbsp;<\/p>\n\n\n\n<p>Polymarket is re-entering the US market through the $112 million acquisition of <strong>QCEX<\/strong>, a CFTC-licensed derivatives exchange. The deal will allow Polymarket to operate under QCEX\u2019s license and list its contracts as tradable derivatives.<\/p>\n\n\n\n<p>However, across the pond, the GGL has now put all event contracts that are not sports-related under the \u201cillegal betting\u201d graph.<\/p>\n\n\n\n<p>Due to the volatility of any real-world event that is not sports-related, the GGL clarified that event contracts are not eligible for approval under the Gambling State Treaty 2021 (Gl\u00fcStV 2021).&nbsp;<\/p>\n\n\n\n<p>\u201cSuch formats are particularly susceptible to manipulation, as they are often based on unclear, subjective, or controllable events,\u201d the GGL said in a statement.<\/p>\n\n\n\n<p>\u201cThe legislator has only allowed bets on defined sporting events with verifiable results and clear rules as eligible for approval.\u201d<\/p>\n\n\n\n<p>GGL warned that those found to be participating in or facilitating such types of bets will be viewed as being in breach of Gl\u00fcStV 2021, which is punishable by law.<\/p>\n\n\n\n<p><strong>Illegal market remains top concern for Germany<\/strong><\/p>\n\n\n\n<p>The latest causes only go to show how nuanced the gambling sector can be, with something completely legal in one place being scrutinised elsewhere.
