{"id":11282,"date":"2025-10-29T08:31:33","date_gmt":"2025-10-29T08:31:33","guid":{"rendered":"https:\/\/sbceurasia.com\/en\/?p=11282"},"modified":"2025-10-29T08:31:37","modified_gmt":"2025-10-29T08:31:37","slug":"entain-appeals-austrac-investigation","status":"publish","type":"post","link":"https:\/\/sbceurasia.com\/en\/2025\/10\/29\/entain-appeals-austrac-investigation\/","title":{"rendered":"Entain Appeals AUSTRAC Investigation"},"content":{"rendered":"\n<p><strong>Entain Plc<\/strong> has confirmed that its Australian division has filed an appeal against the penalty proceedings initiated by the <strong>Australian Transaction Reports and Analysis Centre (AUSTRAC)<\/strong>.<\/p>\n\n\n\n<p>\u201c<strong>Entain Australia<\/strong> (Entain Group Pty Ltd) has filed its defence in response to AUSTRAC\u2019s amended statement of claim in the Federal Court of Australia,\u201d the parent company stated.<\/p>\n\n\n\n<p>The dispute stems from an AUSTRAC investigation into Entain Australia, during which the financial regulator uncovered alleged cases of systematic non-compliance with <strong>Australia\u2019s Anti-Money Laundering and Counter-Terrorism Financing (AML\/CTF) Act of 2006<\/strong>.<\/p>\n\n\n\n<p>The allegations against brands including <strong>Ladbrokes Australia, Neds, Betstar and Bookmaker.com.au<\/strong> claim that their AML programmes during the investigation period &#8211; <strong>from December 2018 to December 2024<\/strong> &#8211; failed to meet compliance standards. The brands are accused of shortcomings in key processes for verifying customer accounts and determining the source of funds for large transactions.<\/p>\n\n\n\n<p>Additionally, Entain was accused of using third parties, affiliates, and cash-deposit channels that allegedly allowed funds from potentially opaque sources to be credited into betting accounts.<\/p>\n\n\n\n<p>Initially, Entain announced that it had begun mediation and was cooperating with AUSTRAC, as well as launching a remediation programme to strengthen its Australian AML\/CTF systems. The programme, which began in December 2022, was expected to be completed by June 2026.<\/p>\n\n\n\n<p>However, AUSTRAC has not yet filed or disclosed the potential fine amount, although Entain previously warned that any sanction could be \u201csignificant.\u201d<\/p>\n\n\n\n<p>The company confirmed that its Australian arm is prepared to challenge several of the regulator\u2019s claims. In its statement, Entain acknowledged certain shortcomings in its AML\/CTF compliance programme between <strong>December 2018 and August 2024<\/strong>, but it disputes a number of AUSTRAC\u2019s allegations and interpretations.<\/p>\n\n\n\n<p>The company stressed that over the past two years it has completely overhauled its compliance framework, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a tenfold increase in AML\/CTF staff;<\/li>\n\n\n\n<li>tens of millions of dollars invested in new systems and technologies;<\/li>\n\n\n\n<li>closure of higher-risk channels &#8211; including all cash payment channels, which previously accounted for less than 2% of deposits;<\/li>\n\n\n\n<li>closure of all 17 customer accounts mentioned in the case &#8211; prior to legal proceedings, some as early as 2020;<\/li>\n\n\n\n<li>implementation of new governance, risk control, and oversight systems; and<\/li>\n\n\n\n<li>formation of a new leadership team at Entain Australia built on a \u201ccompliance-first\u201d culture.<\/li>\n<\/ul>\n\n\n\n<p>Entain stated that it continues to engage with AUSTRAC \u201cconstructively and in good faith.\u201d<\/p>\n\n\n\n<p><strong>Andrew Vouris,<\/strong> CEO of Entain Australia and New Zealand, commented: \u201cWe sincerely regret that our old programme didn\u2019t meet expectations. We followed expert advice at the time but, looking back, we recognise the old programme missed the mark.<\/p>\n\n\n\n<p>We\u2019ve acknowledged our shortcomings, taken responsibility, and spent the last two years learning from them and fixing them. Entain has fundamentally transformed its approach to compliance and now operates a market-leading programme, underpinned by a compliance-first culture \u2013 to win, but not at all costs<em>.<\/em>\u201d<\/p>\n\n\n\n<p>Company leadership, including CEO <strong>Stella<\/strong> <strong>David<\/strong> and Deputy CEO\/CFO <strong>Rob<\/strong> <strong>Wood<\/strong>, previously expressed confidence that the matter would be resolved through mediation without a significant fine.<\/p>\n\n\n\n<p>Analysts, however, suggest that AUSTRAC\u2019s case could result in a multi-million-dollar penalty &#8211; similar to previous precedents:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>AU$450 million (\u20ac270 million) for Crown Resorts, and<\/strong><\/li>\n\n\n\n<li><strong>AU$67 million (\u20ac40 million) for SkyCity Entertainment Group<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>The AUSTRAC investigation adds another regulatory risk for Entain, which is still recovering from a series of compliance fines affecting its 2023\u20132024 UK operations.<\/p>\n\n\n\n<p>In 2023, Entain reached a record <strong>\u00a3585 million<\/strong> settlement with <strong>HMRC<\/strong> to resolve a long-running investigation into alleged bribery and failure to prevent corruption in its former Turkish-facing operations (under <strong>GVC Holdings<\/strong>).<\/p>\n\n\n\n<p>The settlement included:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00a3465 million in penalties,<\/li>\n\n\n\n<li>\u00a3120 million in disgorged profits, and<\/li>\n\n\n\n<li>\u00a320 million in charitable contributions.<br>This marked the largest fine ever imposed on a UK gambling operator.<\/li>\n<\/ul>\n\n\n\n<p>However, a subsequent 2024 <strong>UKGC<\/strong> investigation led to another <strong>\u00a33 million <\/strong>fine for shortcomings in social responsibility and AML compliance across Entain\u2019s online and retail divisions.<\/p>\n\n\n\n<p>Against this backdrop, the AUSTRAC case is seen as Entain\u2019s final major regulatory exposure.
