{"id":11285,"date":"2025-10-29T11:45:24","date_gmt":"2025-10-29T11:45:24","guid":{"rendered":"https:\/\/sbceurasia.com\/en\/?p=11285"},"modified":"2025-10-29T11:45:29","modified_gmt":"2025-10-29T11:45:29","slug":"the-european-union-may-fine-meta-and-tiktok-for-failing-to-comply-with-online-platform-regulations","status":"publish","type":"post","link":"https:\/\/sbceurasia.com\/en\/2025\/10\/29\/the-european-union-may-fine-meta-and-tiktok-for-failing-to-comply-with-online-platform-regulations\/","title":{"rendered":"The European Union May Fine Meta and TikTok for Failing to Comply With Online Platform Regulations"},"content":{"rendered":"\n<p><strong>Meta<\/strong> and <strong>TikTok<\/strong> could be in breach of the EU\u2019s tech regulations and face a penalty of up to 6% of their global annual turnover.<\/p>\n\n\n\n<p>The <strong>European Commission (EC)<\/strong> has preliminarily found that Facebook, Instagram and TikTok failed to be transparent and allow researchers adequate access to public data, under the <strong>Digital Services Act (DSA).<\/strong><\/p>\n\n\n\n<p>The bloc said the platforms \u201cmay have put in place burdensome procedures and tools\u201d, resulting in unreliable data and impacting the ability to conduct research such as minors being exposed to illegal or harmful content.<\/p>\n\n\n\n<p>Under the DSA, large online platforms \u2013 those with more than 45 million users per month \u2013 must grant accredited researchers access to public data in order to monitor the content posted on it.<\/p>\n\n\n\n<p>The EC also found Meta \u2013 for both <strong>Facebook<\/strong> and <strong>Instagram<\/strong> \u2013 to be in breach of its obligations to provide users with simple mechanisms to notify illegal content and effectively challenge content moderation decisions.<\/p>\n\n\n\n<p><strong>Henna Virkkunen<\/strong>, executive vice-president for tech sovereignty, security and democracy, said: \u201cOur democracies depend on trust. That means platforms must empower users, respect their rights, and open their systems to scrutiny.<\/p>\n\n\n\n<p>\u201cThe DSA makes this a duty, not a choice. With today\u2019s actions, we have now issued preliminary findings on researchers\u2019 access to data to four platforms. We are making sure platforms are accountable for their services, as ensured by EU law, towards users and society.\u201d<\/p>\n\n\n\n<p>The findings come as the commission wraps up its investigations into big tech companies under the the DSA, which aims to combat the spread of illegal content and products online.<\/p>\n\n\n\n<p>This investigation may have some relevance for the betting and gambling sectors, with Meta in particular having upped its game this year to ensure content on its platforms does not violate the specific gambling laws of the various countries it is active in.<\/p>\n\n\n\n<p>Regarding the EC\u2019s more recent conclusions around tech regulations, Meta and TikTok now have the opportunity to view and reply to the commission\u2019s findings in writing.<\/p>\n\n\n\n<p>The EC will consult with the European Board for Digital Services and if the findings are confirmed, the commission may issue a non-compliance decision.
