Google\u2019s<\/strong> longstanding battle with the Department of Justice<\/strong> (DOJ)<\/strong> came to a head last year when US District Judge Amit Mehta<\/strong> found the tech giant to hold an illegal monopoly in search and search advertising. Following the ruling, the DOJ had argued for stronger remedies including the potential sale of its Chrome <\/strong>browser, which Mehta deemed a \u201cpoor fit for this case\u201d. Instead the Alphabet-owned company was ordered to open up access to search data for competing firms and revise its handling of key commercial agreements.<\/p>\n\n\n\n

The latest document places a set of restrictions on Google, including no longer entering into long-term default search agreements.<\/p>\n\n\n\n

Mehta wrote in the filings on Friday: \u201cThe age-old saying \u2018the devil is in the details\u2019 may not have been devised with the drafting of an antitrust remedies judgment in mind, but it sure does fit.\u201d<\/p>\n\n\n\n

The tech giant paid more than $26bn<\/strong> for such deals with Apple, Mozilla and others<\/strong> in 2021.<\/p>\n\n\n\n

Under the limitations, such contracts are to be capped at one year.<\/p>\n\n\n\n

The same restrictions apply across Google\u2019s wider business and covers any agreements involving generative AI products and any \u201capplication, software, service, feature, tool, functionality, or product\u201d, built on large language models.<\/p>\n\n\n\n

GenAI \u201cplays a significant role in these remedies,\u201d Mehta added.<\/p>\n\n\n\n

The judge also included requirements on who should be in the technical committee, which will determine with whom Google is to share its search data with.<\/p>\n\n\n\n

\u201cMembers shall be experts in some combination of software engineering, information retrieval, artificial intelligence, economics, behavioural science, and data privacy and data security,\u201d he wrote in the filings.<\/p>\n\n\n\n

Mehta emphasised that committee members must not have worked for Google or any of its competitors in the six months prior to serving in the role and it must have access to \u201cGoogle\u2019s source code and algorithms, subject to a confidentiality agreement\u201d.<\/p>\n\n\n\n

In a statement issued by Google earlier this year on sharing search data, Lee-Anne Mullholland,<\/strong> Vice President, Regulatory Affairs, said: \u201cNow the court has imposed limits on how we distribute Google services, and will require us to share search data with rivals. We have concerns about how these requirements will impact our users and their privacy, and we\u2019re reviewing the decision closely.\u201d<\/p>\n\n\n\n

This is not the only antitrust trial Google is facing: in April the court ruled the tech firm has an illegal monopoly in adtech when it tied two its tools together. US District Court Judge Leonie Brikema<\/strong> is yet to give her verdict on the remedies, but has questions whether a break-up of Google\u2019s adtech business is the best solution to restore competition.<\/p>\n\n\n\n
